AMBILOGIQUE HARDWARE WARRANTY

AmbiLogique products are warranted free from defects in material and workmanship for 3 years from date of purchase.  This warranty does not cover fuses, batteries, damage from neglect, misuse, contamination, alteration, accident or abnormal conditions of operation or handling, including failures caused by use outside of the product’s specifications, or normal wear and tear of mechanical components.  This warranty covers the original purchaser only and is not transferable.

AmbiLogique products are serialized, either overtly or covertly.  AmbiLogique reserves the right to determine date of purchase from the product serial number in conjunction with AmbiLogique’s shipping records.

AmbiLogique will, at its option, repair at no charge or replace the defective item, or refund the purchase price.

A Return Material Authorization (RMA) number must be obtained from the AmbiLogique factory and clearly marked on the outside of the package before any equipment will be accepted for warranty work. AmbiLogique will pay the shipping costs of returning to the owner parts which are covered by warranty.

Before making any non-warranty repair or replacement, AmbiLogique will estimate the cost and obtain authorization from you, then invoice you for repair and return transportation.

THIS WARRANTY IS YOUR ONLY REMEDY.  Except as specified herein,AmbiLogique makes no warranties, express or implied, and specifically disclaims any warranty of merchantability or fitness for a particular purpose. Customer’s right to recover damages caused by fault or negligence on the part of AmbiLogique shall be limited to the amount theretofore paid by the customer. AmbiLogique will not be liable for damages resulting from loss of data, profits, use of products, or incidental or consequential damages, even if advised of the possibility thereof. This limitation of the liability of AmbiLogique will apply regardless of the form of action, whether in contract or tort, including negligence. Any action against AmbiLogique must be brought within one year after the cause of action accrues. AmbiLogique shall not be liable for any delay in performance due to causes beyond its reasonable control. The warranty provided herein does not cover damages, defects, malfunctions, or service failures caused by owner’s failure to follow the AmbiLogique installation, operation, or maintenance instructions; owner’s modification of the product; owner’s abuse, misuse, or negligent acts; and power failure or surges, fire, flood, accident, actions of third parties, or other events outside reasonable control.

Resellers are not authorized to extend any different warranty on behalf of AmbiLogique Ltd.

Since some states do not allow the exclusion of limitation of an implied warranty or of incidental or consequential damages, this limitation of liability may not apply to you.  If any provision of this warranty is held invalid or unenforceable by a court or other decision-maker of competent jurisdiction, such holding will not affect the validity or enforceability of any other provision.
